Well, the police report, in a nutshell, is basically lie upon lie. What else do you expect from cops. What is should have said is this:
“I pulled Amber Spencer over for a loud exhaust. When I pulled her over she handed me her liscence, registration, and proof of insurance. While making her get out of her car she reached down to put her shoes on. There was a bag underneath her legs, which she did not touch at all. I then told her that I could smell marijuana so I could have a probable cause to search her car without having to actually have any proof whatsoever. This is a trick that I use any time I feel like I have the possibility of finding weed. I can usually tell who smokes by the way they look. I have used this excuse before on Amber during the summer of the previous year, but did not find any marijuana in her other car (which did not smell like marijuana because she hadn’t smoked in it at all that week or on previous dates). On this night her new car did not smell like marijuana because her and her friends aren’t that stupid to smoke in a car that runs the risk of being pulled over. I then told her that I would return to my car to check her information and she could return to her car to talk it over with her friends and upon my returnal I would have her produce some mary jane. But then I decided to start interrogating her (pointing out that I had remembered pulling her over and had smelled weed that time, as well). I then abruptly asked to search her bag, in which she said “No, I don’t have one for you to search.” I then told her that the one under her feet must be hers and I kept pressuring her until she handed over, saying things like, “It doesn’t matter if it’s yours or not. It’s in your possession, so you have control over it.”. She then handed it over to me. When I found the marijuana she admitted it to have been her bag. I found many items, such as purfume which, in my mind, is a dead giveaway, and I said “Having perfume doesn’t help.”. I then searched her car without her permission while the passangers were still in it while I forced her to stand by my police car. Then deciding that this was a very extreme and dangerous crime, I called upon two or three other cop cars in the area to come join me, so they can stand around and stare at and harrass the passangers, as well as the driver. Being worried for her daughter’s well being and unaware of what was happening, her mother (who had been waiting for their arrival elsewhere and who showed up on the side of the road where we were at) kept on asking questions. One cop replied “I don’t know what’s going on, *Laughs* I just got here.” Then we made her return to her car, not willing to go at first, we then threatened to take her to the department. I then searched one passanger’s bag and forced her to take off her hat and, in her mind, embarrassed her. Not willing to take her hat off at first, I responded in a really quiet, harsh voice, telling her to “Take it off!”. During this time Deputy Chambers noticed the three passangers in the back kept turning around to check what was going on and went up and shone the flashlight in their eyes and asked, “Is there a problem.” I then made all of the passangers get out one by one and show me all of their personal belongings. After everyone was out of the vehicle, I then searched everywhere again. I arrested two who were in possession of a harmless drug and let one who was also in possession go. When they arrived at the jail cell, they were refused a phone call. They then spent four or so hours in the jail, then were bailed out by their parents at two a.m.”.
Interview Driver: Amber Nicole Spencer W/F 08/04/1994
“While on duty in the Village of Bellaire I observed a small black vehicle pass my patrol unit and the exhaust was defective. I made a traffic stop on this vehicle and made contact with the driver on the driver side of the vehicle. While walking up to the vehicle I noticed the small vehicle had 5 occupants. The driver identified herself with a Michigan Operators Liscence as Amber Nicole Spencer W/F 08/04/1994. While talking with Spencer I could smell a very strong odor of marijuana coming from the vehicle.
I questioned Spencer about the odor of marijuana and she denied any knowledge of marijuana in her vehicle. When Spencer exited her vehicle she pushed a purse under her seat. Spencer told me the purse did not belong to her and it belongs to a friend. I requested Spencer remove the purse from the vehicle. She told me I would not know her. Spencer then told me that her books were inside the purse. While searching her purse I found a green pill bottle with 1 gram of marijuana. I field tested this at the office and it tested positive. Spencer then tells me that the purse belongs to her. Spencer would nor provide any information about any other marijuana that could be in her vehicle. While searching her purse I could smell mild odor marijuana from her purse. Spencer gave me permission to search her vehicle. Spencer told me she had not smoke marijuana for a while. When I examined the marijuana from the green pill bottle the plastic packaging was still sealed in the bottle. I also found a small metal pipe in the purse. Spencer was arrested and transported by Deputy Chambers to the Antrim County Jail.”
